Don’t Let New Laws Stifle Your Giving: Take Action Today

The bill could displace giving that would otherwise go to nonprofits.

Proposed legislation—specifically the IRA Charitable Rollover Facilitation and Enhancement Act, HR 2891—misleads older donors and encourages them to roll IRA funds into donor-advised funds, where wealth will be hoarded and isolated, instead of to nonprofits, where the donation will be immediately deployed in the community.

At the end of every year, donors aged 70.5 and older typically begin receiving mailers about rolling over their “required minimum distribution” from their IRA to a charitable organization, rather than receiving it as taxable income. Many nonprofits use this unique tax benefit as part of their end-of-year giving strategy with great success. In 2025, this special group of donors could give up to $108,000 through their IRA and avoid extraneous taxes.

Best of all, private foundations and donor-advised funds have been ineligible to receive these funds, meaning that 100% of the charitable benefits have flowed into local communities through nonprofits with no middleman or administrative headache. 

The IRA Charitable Rollover Facilitation and Enhancement Act changes that.
